Terms of Service
Effective Date: February 2024
1. Introduction
Thank you for choosing Mocktails by Anike. These terms of service constitute the agreement between the customer and Mocktails by Anike. By making a payment through the invoice, the customer acknowledges and agrees to these terms of service. Please note that these terms of service are subject to change without prior notice.
2. Payments
- All sales are considered final.
- Payments are non-refundable, and store credit can only be issued by Mocktails by Anike Management. For store credit requests, please submit them in writing via email to info@mocktailsbyanike.com. Mocktails by Anike has 14 days to review your request and provide an outcome via the email address of the requester.
- An initial deposit of 60% is required for booking. The initial deposit secures your event date, is non-refundable, and non-transferable. It cannot be converted to store credit or applied to future dates. As we accept your event order, we initiate the process of declining other orders. As your event date approaches, re-booking your date becomes increasingly unlikely.
- A service charge of 25% will be applied to the invoice.
- Other charges that may apply includes:
– Transportation Fee: This fee will vary depending on the event location.
– Labour/ Assistance Fee: This fee is subject to the quantity of orders.
– Rental Fee: This fee will be determined based on the client’s style and preferences. - Final payments must be received within the specified timeframes below. Reservation deposits should be received within 72 hours of invoice receipt. Final payments are due on the date indicated in the invoice.
3. Menu to be Served
The parties have agreed to the menu that was invoiced to the clients. Our team reserves the right to make small changes to the menu if key ingredients are unable to be served due to reasons beyond the control of the parties. Any changes to the agreed-upon order or presentation will be discussed with the client to obtain approval before sourcing, preparing, or serving. Our drinks are all non-alcoholic beverages; therefore, we will not provide alcohol with your orders. We kindly require a minimum order value of 30 cups to cater at your event.
4. Legal Compliance
Mocktails by Anike will work in compliance with all applicable local health department rules and regulations relating to food preparation and food service.
5. Insurance and Indemnification
Mocktails by Anike has or will obtain general liability insurance relating to the caterer’s services at the event. However, the client will indemnify and hold harmless Mocktails by Anike staff for any damage, theft, or loss of property occurring at the event caused by any of the client’s guests.
6. Changes
- The final date for changes related to the menu, flavors, and set-up style is 14 days before the event. Any changes made after this date cannot be guaranteed and may be subject to additional charges.
- All changes to existing orders must be submitted in writing via email only. Changes communicated via phone, social media messaging, text, etc., may not be honored.
- Seasonal items may incur an additional charge or may be substituted if unavailable.
7. Variations
- While Mocktails by Anike makes every effort to provide the flavor, decoration, size, color, shape, and design as discussed during consultations, beverages creation is an art form and may be subject to variations.
- If the customer supplies an image or likeness to be created, Mocktails by Anike will make every attempt to make the item as close to the likeness as possible. In cases where the product requires equipment or ingredients that cannot be obtained within the time allotted (exotic flavors, molds, shapes, stamps, texture, additional novelty such as glitter), the closest available resemblance will be used to complete the product.
- Color matching is not an exact science, and different syrup substrates absorb color differently. Mocktails by Anike will strive to make substrates match each other and provide color swatches, but a 100% perfect color match may not always be achievable.
- To maintain the stability and integrity of your event beverages, Mocktails by Anike reserves the right to make design and structural changes to your beverages on-site or off, without prior notification.
8. Site & Venue Conditions
- Mocktails by Anike will need to have access to the venue no later than 1 hour in advance before the start of the event and 1 hour after the end time for clean-up. Clients will make the necessary arrangements at the client’s expense to get this access arranged.
- The venues must have sink stations in the serving area (washrooms don’t count) to ensure appropriate washing and cleaning of all fruits and supplies.
- Mocktails by Anike reserves the right to refuse the setup of drinks in any location that is not adequately air-conditioned or weatherproof or on any beverage plateau or stand that does not appear sturdy enough to hold the weight of our beverages.
- Once drinks are set up, they are not intended to be moved until they are ready to be served. Mocktails by Anike is not responsible for damage caused by others after the drink is set up by our staff.
9. Rights & Waivers
- Mocktails by Anike reserves the right to take photos of the product for display or promotional purposes without the customer’s consent.
- The product may contain or come into contact with milk, wheat, nuts, soy, and other allergens. The guests are responsible for reading the menu lists for full ingredients and recipes. Mocktails by Anike is not responsible for any adverse effects of allergic reactions.
- In the event of a natural disaster, accident, or other situation outside of Mocktails by Anike’s control, this contract may be voided.
- Mocktails by Anike will strive to provide its services professionally and ensure a high level of customer satisfaction. In cases where our products or services do not meet our standards or the client is dissatisfied, we may, at our discretion, provide the amount paid for those products and services in the form of store credit. Mocktails by Anike’s total liability is limited to the amounts paid for its goods and services. We will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of the basis of liability, such as breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise.
- Only items, actions, and beverage details explicitly listed in the invoice are guaranteed by Mocktails by Anike.
10. Equipment Rental
- Based on the client’s design and preference, a rental fee will be included in the invoice to cover the equipment rentals.
11. Disputes & Grievances
- All disputes and grievances related to service provided or products delivered must be submitted in writing via email within 7 days of the date of service.
- All food sales are final. All payments are non-refundable. Any compensation provided in response to a dispute or grievance will be in the form of store credit only.
- The Parties will attempt in good faith to resolve any dispute or claim through negotiations between a director of each Party with authority to settle the dispute. If the dispute cannot be settled amicably within thirty (30) days, then the remaining provisions of this clause shall apply.
- The determination of the arbitration entity is final and cannot be disputed further.
- The performance of this Agreement shall continue during arbitration proceedings or any other dispute resolution mechanism. No payment due or payable by the customer shall be withheld on account of a pending reference to arbitration or other dispute resolution mechanism except to the extent that such payment is the subject of such dispute.
12. Cancellations
- We understand that unforeseen events happen. Any cancellations must be made 72 hours in advance in writing and may result in store credit ONLY.
13. Event Tickets
When you purchase tickets for our events, you acknowledge and agree that:
- The event organizer has the right to add or vary the advertised program, seating arrangements, and audience capacity and deny admission with reasonable cause, including due to intoxication, unsociable behavior, failure to observe lawful directions, or possession of an invalid ticket.
- It is your responsibility to provide correct e-ticket information (QR code) to gain access to the event hall.
- We reserve the right to cancel any ticket and refund the amount paid in full where there has been an error in ticket pricing, whether due to human error or a transactional malfunction on the site and offer to rectify such an error by re-processing the transaction with the correct ticket pricing.
- All ticket sales are final. No refunds or exchanges are provided for lost or stolen tickets or for a failure on your part to show up at the event.
